Computer Forensics
The
existence and discovery
of electronic data is frequently
a contentious issue in
litigated matters. Indeed,
compromising electronic
evidence has often been
the “smoking gun”,
that critical piece of
evidence that makes or
breaks a case. This is
why we at Sage Forensic
Accounting take the methods
of extracting, examining,
and evaluating electronic
data very seriously. We
have the equipment, training
in computer forensics,
and resources to recover
digital data, in most cases
regardless of the steps
that may have been taken
to hide or destroy it.
The following case study
presents a small sample
of the types of engagements
where our forensic accounting
services can be helpful.

When
what you see isn’t
what you can get…
Problem
Pete has a feeling that he’s
missing something. Although his
divorce has been going fairly
smoothly, he remembered that
a few years ago his wife had
made a series of off-shore investments
using funds from their joint
bank account. His wife now claims
that she never made any such
investments and during the discovery
process he had not seen any documents
relative to these investments.
Since Pete’s wife maintained
the family finances on a computer
that was subject to discovery,
Pete searched that computer in
an attempt to locate electronic
documentation of the investments
but was unable to locate anything
meaningful. He suspects that
if such a document had ever existed
on the computer it may have been
deleted. What can Pete do to
try and find this electronic
information, if it exists?
Issues to
Consider
Electronic discovery has gone
through significant changes recently.
As technology becomes more integrated
into the way we do business and
lead our lives, the electronic
trails we leave behind, whether
intentional or not, grow more
and more comprehensive. In addition
to ensuring that information
retrieval methods are well understood
and executed, it is imperative
that a secure chain of custody
be maintained when providing
electronic information for use
in litigation. At Sage Forensic
Accounting, we have the expertise
and experience to address these
issues. |
